1. Introduction and Definitions

1.1 Who We Are
Harley Institute of Aesthetics ("Harley Institute", "we", "us" or "our") provides professional education, training and development programmes in aesthetics, aesthetic medicine, hair restoration, trichology, regenerative medicine and related disciplines.

Harley Institute of Aesthetics is a trading division of the European School of Applied Sciences.

These Terms and Conditions govern your use of our website and your purchase of, application for, enrolment on or participation in our courses, programmes, clinical training, fellowships, events and other educational services.

1.2 Definitions
In these Terms and Conditions:

"Course" or "Programme" means any course, qualification, certificate, diploma, postgraduate programme, CPD programme, workshop, clinical training programme, fellowship or educational service provided by Harley Institute of Aesthetics.

"Learner", "Student" or "Delegate" means any individual who applies for, purchases, enrols on or participates in a Course or Programme.

"Clinical Fellowship" means a structured programme of supervised clinical education, practical exposure, competency development and professional learning.

"Practical Training" means any supervised practical, clinical, simulated, observational or hands-on learning activity.

"Model" or "Clinical Participant" means an individual who participates in practical or clinical training activities and may receive a treatment or procedure where applicable.

"Training Materials" means all course materials, manuals, videos, presentations, assessments, online resources, intellectual property and other educational content provided by us.

"Website" means the Harley Institute of Aesthetics website and any associated digital platforms operated by or on behalf of us.

1.3 Interpretation
Words in the singular include the plural and words in the plural include the singular where the context permits.

Headings are included for convenience only and do not affect the interpretation of these Terms and Conditions.

2. Our Contract with You
2.1 These Terms and Conditions apply to the educational services, courses, programmes, products and practical training activities supplied by Harley

Institute of Aesthetics.

2.2 By submitting an application, making a booking, paying a fee, enrolling on a Programme or participating in any of our educational activities, you

confirm that you have read, understood and agree to be bound by these Terms and Conditions.

2.3 Additional terms, policies, programme regulations, learner handbooks, assessment regulations, clinical policies or practical training

requirements may apply to particular Programmes. Where additional programme-specific requirements apply, you will be required to comply wit them.

2.4 Your enrolment, booking or application does not guarantee admission until we have confirmed your place in accordance with our admissions and enrolment procedures.

2.5 You confirm that all information supplied to us is accurate, complete and up to date. This may include information relating to:

• Your identity

• Qualifications

• Professional background

• Professional registration

• Employment

• Previous training

• Medical information relevant to practical participation

• Any other information required for admission or participation

2.6 We reserve the right to withdraw an offer, cancel enrolment or terminate participation where information provided by you is materially inaccurate, misleading, incomplete or fraudulent. Where this occurs, refunds may not be available.

3. Admissions, Entry Requirements and Eligibility
3.1 Each Programme may have specific entry requirements. These may include:

• Academic qualifications

• Professional qualifications

• Professional registration

• Relevant professional experience

• Previous training

• English-language proficiency

• Evidence of identity

• Professional references

• Other requirements relevant to the Programme

3.2 It is your responsibility to ensure that you meet the published entry requirements before applying or enrolling.

3.3 We may request documentary evidence to verify your qualifications, identity, professional registration or experience.

3.4 Where a Programme involves practical or clinical activities, additional eligibility, competency, health, safety or professional requirements may apply.

3.5 Admission to a Programme does not guarantee that a learner will be eligible to independently perform any treatment, procedure or professional activity following completion.

Learners remain responsible for ensuring that their professional activities are permitted within their:

• Scope of practice

• Professional registration

• Competence

• Insurance arrangements

• Local legislation

• Applicable regulatory requirements

4. Fees and Payment
4.1 Programme fees will be communicated on the relevant course or programme page, quotation, invoice or enrolment agreement.

4.2 Unless otherwise agreed in writing, all fees must be paid in accordance with the payment schedule provided to you.

4.3 Where instalment plans are available, the learner remains responsible for payment of all instalments in accordance with the agreed payment plan.

4.4 Failure to make a payment when due may result in:

• Suspension of access to learning materials

• Suspension from classes or practical training

• Withholding of assessments

• Withholding of results

• Delayed certification

• Suspension of enrolment

• Recovery action where appropriate

4.5 Unless otherwise stated, course fees do not include:

• Travel

• Accommodation

• Visa costs

• Personal insurance

• Professional registration

• External examination fees

• Third-party administrative fees

• Other personal expenses

5. Digital Learning Materials and Online Access
5.1 Some Programmes include immediate or early access to digital learning materials, online platforms, recorded lectures, videos, manuals or other digital content.

5.2 Digital access may be provided following enrolment, payment or confirmation of your place.

5.3 Where digital content has been supplied or access has commenced, your statutory cancellation rights may be affected in accordance with applicable consumer law. Where required, we will obtain your acknowledgement or consent before providing immediate access to digital content.

5.4 You must not:

• Copy

• Reproduce

• Share

• Sell

• Redistribute

• Publish

• Upload

• Record

• Commercially exploit

our Training Materials without prior written permission.

6. Cancellations, Refunds and Changes

6.1 Learner Cancellation
Cancellation requests must be submitted in writing using the contact details specified by Harley Institute of Aesthetics.

6.2 Refund eligibility will depend on:

• The type of Programme

• Whether digital learning materials have been accessed

• Whether teaching or training has commenced

• The date of cancellation

• The terms of any payment plan

• Any programme-specific cancellation policy communicated at enrolment

6.3 Programme-specific cancellation and refund policies may apply and will form part of the learner's agreement with us.

6.4 Deposits, registration fees, administrative fees or amounts allocated to digital learning materials may be non-refundable where clearly communicated at the time of booking and permitted by applicable law.

6.5 Failure to attend a class, assessment, practical session, fellowship placement or other scheduled activity does not automatically entitle the learner to a refund.

6.6 Requests to defer or transfer enrolment may be considered at our discretion and may be subject to:

• Programme availability

• Academic requirements

• Administrative fees

• Cohort capacity

• Programme-specific rules

6.7 Where a learner has entered into an instalment arrangement, cancellation of participation does not automatically cancel any outstanding financial obligations unless confirmed by us in writing.

7. Changes, Postponements and Cancellation by Us
7.1 We may make reasonable changes to:

• Course content

• Teaching methods

• Module sequencing

• Timetables

• Faculty

• Assessment methods

• Learning platforms

• Venues

• Delivery arrangements

Such changes may be necessary to maintain academic quality, respond to professional developments or comply with legal, regulatory or operational requirements.

7.2 We reserve the right to postpone, reschedule or change the location of a Programme where reasonably necessary.

7.3 Where reasonably practicable, we will provide affected learners with notice of significant changes.

7.4 If we cancel a Programme before it begins and are unable to offer a reasonable alternative, we will deal with refunds in accordance with applicable law and the relevant enrolment agreement.

7.5 We are not generally responsible for travel, accommodation, visa or other expenses incurred by learners as a result of changes to a Programme, unless required by applicable law.

8. Attendance and Participation
8.1 Learners are expected to attend and actively participate in scheduled educational activities.

8.2 Some Programmes may have minimum attendance requirements.

8.3 Failure to meet attendance requirements may affect:

• Progression

• Assessment eligibility

• Practical competency

• Fellowship completion

• Eligibility for certification

8.4 Learners must arrive on time and be appropriately prepared for scheduled activities.

8.5 Where a learner arrives late or misses essential training, we may restrict participation in practical or clinical activities where necessary to protect educational standards or patient safety.

9. Practical and Clinical Training
9.1 Practical and clinical training is subject to:

• Learner competence

• Faculty supervision

• Patient or model availability

• Health and safety requirements

• Programme requirements

• The professional judgement of supervising staff

9.2 We cannot guarantee that every learner will perform every possible procedure on a live patient or model. The availability of practical opportunities may depend on factors outside our reasonable control.

9.3 Learners may be required to demonstrate theoretical understanding and practical readiness before participating in particular activities.

9.4 Supervisors may restrict, modify or stop a learner's participation in a practical activity where they consider this necessary for safety, professional standards or patient welfare.

9.5 Clinical and practical activities are educational activities and must not be interpreted as conferring unrestricted independent practice rights.

10. Clinical Fellowship Programmes
10.1 Clinical Fellowship Programmes are designed to provide structured supervised learning and professional development.

10.2 The nature and extent of practical participation will depend on:

• The learner's previous qualifications

• Existing competence

• Scope of practice

• Professional registration

• Applicable legal requirements

• Supervisor assessment

• Patient safety

10.3 Completion of a Fellowship does not guarantee independent clinical privileges, professional registration, employment, insurance or legal authority to perform procedures.

10.4 Learners must comply with all fellowship policies, clinical governance procedures and supervision requirements.

11. Assessments and Academic Progression
11.1 Learners must complete required assessments in accordance with the relevant Programme regulations.

11.2 Assessments may include:

• Written assignments

• Examinations

• Case-based assessments

• Practical assessments

• Objective structured clinical examinations

• Presentations

• Reflective portfolios

• Clinical competency assessments

• Research proposals

• Dissertations

11.3 Academic or practical progression may be subject to successful completion of prerequisite modules or assessments.

11.4 We may investigate suspected:

• Plagiarism

• Academic misconduct

• Fabrication

• Cheating

• Collusion

• Other breaches of academic integrity

11.5 Serious academic misconduct may result in disciplinary action, failure of an assessment, suspension or termination from the Programme.

12. Certificates and Awards
12.1 Certificates, transcripts or records of achievement will only be issued to learners who have successfully completed all applicable academic, practical, attendance and financial requirements.

12.2 We may withhold certification where a learner has:

• Outstanding fees

• Incomplete assessments

• Outstanding disciplinary matters

• Unfulfilled Programme requirements

12.3 Where a Programme is delivered in partnership with another organisation, the terms and procedures of the relevant awarding, accrediting or validating body may also apply.

13. Learner Conduct
13.1 Learners must behave professionally and respectfully.

13.2 We do not tolerate behaviour that is:

• Abusive

• Threatening

• Harassing

• Discriminatory

• Violent

• Disruptive

• Unsafe

13.3 We reserve the right to remove, suspend or terminate a learner from a Programme where their conduct presents a risk to:

• Patients or models

• Other learners

• Staff

• Academic integrity

• Professional standards

• The safe operation of the Programme

13.4 Where serious misconduct occurs, removal from a Programme may take place without a refund where permitted by applicable law.

14. Confidentiality and Data Protection
14.1 Learners may have access to confidential information during their studies, particularly during clinical or practical activities.

14.2 Learners must not retain, disclose, share or misuse confidential information obtained through the Programme.

14.3 This includes information relating to:

• Patients

• Models

• Other learners

• Staff

• Clinical or institutional activities

14.4 Learners must comply with applicable data protection legislation and our Privacy Policy.

15. Photography, Recording and Social Media
15.1 Learners must not photograph, film, record or publish images of patients, models, clinical activities or other individuals without appropriate authorisation and consent.

15.2 Clinical images may only be used for educational, assessment or clinical purposes where authorised.

15.3 Learners must not publish patient or model information or images on personal social media, websites or other public platforms without appropriate written authorisation.

15.4 We may photograph or record educational activities for quality assurance, educational or promotional purposes where permitted by law and appropriate notice or consent has been provided.

16. Intellectual Property
16.1 All intellectual property rights in our Training Materials remain the property of Harley Institute of Aesthetics, the European School of Applied Sciences or the relevant rights holder.

16.2 Learners receive a limited, personal and non-transferable right to use Training Materials solely for their own educational purposes.

16.3 Learners must not reproduce, distribute, sell, publish or commercially exploit our Training Materials without written permission.

16.4 Unauthorised use of Training Materials may result in disciplinary action and legal action where appropriate.

17. Models and Clinical Participants
17.1 Some Programmes may involve models or clinical participants for educational purposes.

17.2 The availability of models or clinical participants cannot be guaranteed.

17.3 Participation in clinical activities may involve treatment being performed by learners under appropriate supervision, subject to the nature of the Programme and the clinical activity.

17.4 All clinical activities are subject to suitability, consent and professional judgement.

17.5 We reserve the right to decline, postpone or discontinue a clinical activity where we consider this necessary for safety or appropriateness.

18. Health, Safety and Fitness to Participate
18.1 Learners must comply with all applicable health and safety requirements.

18.2 Learners must inform us of any relevant circumstances that may affect their safe participation in practical or clinical activities.

18.3 Where reasonably necessary, we may require a learner to refrain from participating in a particular activity until appropriate safety concerns have been addressed.

19. Professional Scope of Practice
19.1 Learners are responsible for ensuring that any professional activity undertaken outside our supervised training environment is lawful and within their personal scope of practice.

19.2 Completion of any Course or Programme does not automatically:

• Grant professional registration

• Create a licence to practise

• Guarantee insurance coverage

• Grant prescribing rights

• Authorise independent clinical practice

• Override professional, legal or regulatory requirements

19.3 Learners are responsible for obtaining appropriate professional, legal and insurance advice before undertaking independent practice.

20. Employment and Career Outcomes
20.1 We may provide educational, professional development, employment or business guidance.

20.2 Unless explicitly stated in writing, we do not guarantee:

• Employment

• Income

• Business success

• Patient numbers

• Professional registration

• Insurance approval

• Any particular career outcome

21. Limitation of Liability
21.1 Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so.

21.2 Subject to applicable law, we are not responsible for losses arising from circumstances outside our reasonable control.

21.3 We are not responsible for indirect or consequential losses where such limitations are permitted by law.

21.4 Nothing in these Terms and Conditions affects your statutory rights.

22. Events Beyond Our Reasonable Control
22.1 We are not liable for failure or delay in performing our obligations where this results from events beyond our reasonable control. Such events may include:

• Natural disasters

• Fire

• Flood

• Severe weather

• War

• Civil unrest

• Public health emergencies

• Government restrictions

• Major transport disruption

• Utility failures

• Other events beyond our reasonable control

22.2 Where reasonably possible, we will take appropriate steps to minimise disruption and may offer alternative delivery arrangements.

23. Changes to These Terms and Conditions
23.1 We may update these Terms and Conditions from time to time.

23.2 The most current version will be published on our website.

23.3 Material changes affecting enrolled learners will be communicated where reasonably appropriate.

24. General
24.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

24.2 A failure by us to enforce any provision of these Terms does not constitute a waiver of that provision.

24.3 These Terms and Conditions, together with any applicable programme-specific terms, policies and enrolment agreements, form the agreement between you and Harley Institute of Aesthetics in relation to the relevant services.
